◤知多点◢Hospitalization Leave 一定要住院吗?
医生批准员工的Hospitalization leave并让员工回家疗养,然而公司说员工若在在家疗养,不属于Hospitalization leave,因此需要用年假来取代,这是正确的方法吗?

在1955劳工法60F(Section 60F(1)(bb))病假条文里有提到 :
“And provided further that if an employee is certified by such registered medical practitioner or medical officer to be ill enough to need to be hospitalized but is not hospitalized for any reason whatsoever, the employee shall be deemed to be hospitalized for the purposes of this section.”
这段条文意味着,如果医生批准员工Hospitalization leave,但因为某些原因员工没有住院,如医院没有足够的病房,所以院方会安排员工在这段时间回家休养,那员工是被视为可获得Hospitalization leave。
公司可以和医生索取报告,若医生报告证明批准有关员工Hospitalization leave,即使是医院安排员工在家休养,公司需要扣除员工的Hospitalization leave,而并非员工的年假或病假。
